Your rights in the workplace

Many international students in NSW take on part-time or casual work to help pay their living expenses. In Australia, we have basic rights and protection conditions that cover the workplace. This section covers what you need to know before you start work.

Understand your rights

Everyone who works in Australia has the right to minimum pay and conditions – regardless of the length of their stay.

Check your visa rules 

Australian Student Visa holders are normally eligible to work for up to 20 hours a week during term time and full time during holidays, but it is important to check your visa rules to ensure you are allowed to work before you start looking for a job. Check the rules at Visa Entitlement Verification Online (VEVO).

Starting your job

Before you agree to work anywhere it is important that you understand:

  • How much, when and how you will be paid
  • The hours and days you will be working
  • Your working conditions
  • Whether you are employed full time, part time, casually or engaged as a contractor

Discrimination

All Australian workplaces are covered by State and Federal anti-discrimination laws. It is illegal for you to be discriminated against on the basis of race, colour, gender, sexual preference, age, physical or mental disability, marital status, family responsibilities, pregnancy, religion, political opinion, membership or non-membership of a union, national extraction or social origin.
